We’ll do everything we can to keep you out of an Employment Tribunal, but if you do end up receiving a claim, we have the experience to help you.
Tribunal claims can be stressful. It’s your business reputation and finances on the line. From our extensive experience, we know the best ways to take some of the stress away when defending you. First of all, we provide you with open, frank advice about the pros and cons of your case and expert guidance on the best strategy and tactics to use.
We will limit the immediate damage to your business and work with you to resolve the dispute to avoid the claim going any further. Often, we can negotiate a very modest settlement for you, saving you a lot of time and cost. If the dispute cannot be immediately resolved, we will defend your business.
We’ll prepare your defence, and comply with the Tribunal’s directions, case management orders, disclosure duties and the drafting of your witness statements. We can represent you and appear at any Tribunal in the UK. Throughout the process we will review the strengths of each side of the case and look for opportunities to reduce the risk and cost to your business.
Losing at Tribunal can be expensive. In the latest figures from the Ministry of Justice to March 2017:
- The average award for an unfair dismissal claim was £16,543. The most awarded was almost £1.75million.
- The average award for sex discrimination claims is £19,152
- In race discrimination, the most awarded was £456,434 averaging £36,853
- Those successfully bringing disability discrimination claims were awarded on average £31,988
- The highest age discrimination claim saw an award of £154,309 averaging £35,663
Of the 88,476 claims accepted last year, only 182 employers were awarded their costs.
We act quickly
You will only have 28 days from the time the claim is sent to you to file your defence. It feels like a long time but it isn’t. Miss the deadline and you’ve lost the chance to defend yourself or have any say in the proceedings.
